***** ARCHANA PURI, J. (Oral) Mr. Pushp Jain, Advocate, has made appearance on behalf of the respondent and filed Power of Attorney, which is taken on record. Counsel submits that the respondent has no objection if the transfer application is accepted.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/259/2024 titled 'Simranjit Singh v/s Gitika', filed by the respondenthusband, pending in the Family Court, Jalandhar and she seeks transfer of the same to the Court of competent jurisdiction at Pathankot. From the contents of the application, it is evident that there was no child was born from the wedlock of the parties to the lis. The applicant is not having any source of earning. Even, the divorce petition filed at her instance is pending in the courts at Pathankot and the respondent is making HIMANSHU VATS 2026.01.15 09:57 I attest to the accuracy and authenticity of this document

TA-561-2025 appearance in the same, as disclosed by the counsel for the applicant and admitted by the counsel for the respondent.

In view of the submissions made aforesaid by the counsel for the respondent and taking into consideration the fact of other litigation, arising from the matrimonial dispute, already pending in the Courts at Pathankot, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/259/2024 titled 'Simranjit Singh v/s Gitika', filed by the respondent-husband, stands transferred from the Family Court, Jalandhar, to the Court of competent jurisdiction at Pathankot. The requisite record of the aforesaid case be sent by the Family Court, Jalandhar, to the District and Sessions Judge, Pathankot. Learned District and Sessions Judge, Pathankot, shall assign the said petition to the Family Court, Pathankot. Even, the parties are directed to appear before the Family Court, Pathankot, within a period of one month from today onwards.
