(Oral) Prayer is for grant of anticipatory bail in cross case bearing DDR No.26 dated 3.1.2022 registered under Sections 323, 324, 341, 148, 149 and Section 326 IPC in FIR No.320 dated 29.12.2021 registered under Sections 307, 323, 506, 427, 148, 149 IPC and Sections 308, 325, 326 IPC at Police Station Sultanpur Lodhi District Kapurthala. ( 2 ) CRM-M-26404-2022 State along with documents Annexure R-1 to R-7 is ordered to be taken on record.

Counsel for the petitioner submits that the petitioner is an accused in a cross-version case as has been detailed above. The counsel for the petitioner further submits that the petitioner has joined investigation with the police in the light of previous order dated 14.6.2022 passed by the Coordinate Bench of this Court. The counsel for the petitioner further submits that the accused persons in the main case have already been granted concession of interim anticipatory bail.

State counsel on instructions from ASI Balbir Singh has not disputed the fact that the petitioner is accused in cross-version case and has already joined investigation. The State counsel further submits that the weapon of crime has already been recovered and now the petitioner is not required by police for further investigation or for custodial interrogation.. In the light of the above and without commenting on the merits of the case, present petition is allowed and order dated 14.6.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
