(Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.336 dated 20.08.2018, under Sections 363, 366 of Indian Penal Code, Section 376 IPC and Section 4 of POCSO Act has been added lateron, registered at Police Station Sector 39, Chandigarh Learned counsel for the petitioner contends that the petitioner and the daughter of the complainant were in a relationship and they got married on 18.08.2018. Now the parties have compromised the matter. In this regard compromise deed Annexure P-1 has also been executed. CRM-M-50394-2018 -2on behalf of respondent No.2, who submits that the complainant has no objection if the petitioner is released on bail as they have accepted the marriage of their daughter with the petitioner herein. Per contra, learned counsel appearing on behalf of respondentState, on instructions from the Investigating officer opposes the grant of regular bail to the petitioner, while submitting that offences alleged against the petitioner are serious in nature.
I have heard learned counsel for the parties. Since, the parties have compromised the matter, no useful purpose would be served in keeping the petitioner behind bars. At this stage, without commenting on the merits of the case, the instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bonds to the satisfaction of concerned trial Court/Duty Magistrate.
