Learned counsel for the petitioner submits that a totally cryptic and non-speaking order dated 07.04.2025 (Annexure P-8) has been passed by the respondents ignoring the fact that the petitioner was appointed by the respondents-department on the post of Junior Engineer (Civil) with retrospective effect from the year 2001 but the said services rendered by the petitioner starting from December 2001 to 25.10.2007 has not been treated as a qualifying service for the purpose of computing pensionary benefits, whereas in the case of similarly situated employee namely, Sukhwinder Singh, the benefits of said service has been granted to him, which amounts to discrimination.

CWP-11501-2025 (O&M) -2 and liberty be given to the respondents to pass a fresh order in accordance with law by looking into the fact as to whether the similarly situated employees have been granted the said benefit as being claimed by the petitioner in the present petition. Learned counsel for the respondents further submits that the fresh speaking order will be passed within a period of 08 weeks of the receipt of certified copy of this order, which will be duly conveyed to the petitioner.

Learned counsel for the petitioner submits that keeping in view the statement made by the learned counsel for the respondents, present petition may kindly be disposed of having been not pressed any further. 5.
