Raghuvir Singh And Another v. State Of Punjab And Others
CASE HEARD THROUGH VIDEO CONFERENCING
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CRWP No.6304 of 2020 (O&M) Date of decision: 24.08.2020 Raghuvir Singh and another ....Petitioners
Versus
State of Punjab and others ....Respondents CORAM: HON'BLE MR. JUSTICE ARVIND SINGH SANGWAN
Present:
Mr. L.S. Lakhanpal, Advocate for the petitioners. Mr. Joginder Pal Ratra, DAG, Punjab.
ARVIND SINGH SANGWAN J. (Oral) Prayer in this writ petition is for issuance of directions to respondents No.1 to 3 to protect the life and liberty of the petitioners at the hands of respondents No.4 to 13 as the petitioners are living in a live-in relationship and are facing threats from the family members of petitioner No.2.
A perusal of the petition show that petitioner No.2 was married to one Bir Singh son of Madan Lal on 19.04.2018, however, due to matrimonial dispute, she has left the company of her husband and the petitioners now claimed that both of them are living in a live-in relationship.
On the face of it, it appears that in order of avoid any criminal prosecution in case of adultery/bigamy, this present petition has been filed as petitioner No.2 being the spouse of Bir Singh is living with petitioner No.1 in a live-in relationship, without obtaining a decree of divorce from him, for which she has a remedy before a matrimonial court.
At this stage, counsel for the petitioners submits that he may be permitted to withdraw this petition.
Dismissed as withdrawn.
