The prayer in the present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.79 dated 15.03.2025 under Sections 21, 27(a), 29 of the NDPS Act, 1985 and Section 111 of the ! Learned counsel for the petitioner submits that the co-accused of the petitioner was found in possession of 25 unlabelled intoxicating tablets along with a sum of Rs.610/-. The petitioner was named on the basis of a disclosure statement made by main accused Shiv Dayal alias Ruldu. It is further submitted that the said main accused has already been granted interim bail awaiting the FSL report. Learned counsel for the petitioner further prays that the petitioner be also released on bail awaiting FSL report. 3.

Notice of motion.

On the asking of the Court, Mr.Kamalpreet Bawa, DAG, Punjab accepts notice on behalf of the respondent-State. 5.

Learned counsel for the State has opposed the prayer made by the learned counsel for the petitioner.

I have heard learned counsel for the parties and perused the relevant material placed on record.

After hearing learned counsel for the parties and keeping in view the fact that the main accused in the crime in question has been granted interim bail by this Court awaiting the FSL report, the petitioner be also released on interim bail on his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned till the filing of the FSL report. As and when the FSL report is received and supplementary challan is presented, the petitioner is directed to surrender before the Court and seek regular bail.

In view of the aforesaid, the present petition stands disposed of.        ##$ % & '(      !)$
