TAPINDER SINGH MANN 2016.03.16 17:08 IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH.

Cr. Misc. M 8289 of 2016 Date of decision:- 16.3.2016 Satvir Kumar @ Rajan Petitioner vs.

State of Punjab Respondent

Present:

Mr.Sandeep Arora, Advocate.

Mr. Jashanpreeet Singh, AAG, Punjab.

M.M.S.BEDI,J.

The petitioner seeks the concession of regular bail in a case of assault on Vipul on 4.8.2014. As per the statement of complainant Sandeep Singh Sangha, the petitioner has been attributed an injury with a base ball bat on the mouth of Vipul. He has been declined the concession of regular bail on the ground that he had been declared a proclaimed offender. The petitioner has been in custody w.e.f. 4.3.2015. Though the petitioner has been in custody for the last about one year but no witness has been examined. Co-accused of the petitioner has been granted the concession of bail by this court. He has not been attributed any grievous injury on the person of Vipul. The period of detention suffered by the petitioner, in my opinion, is sufficient enough to have deterrent effect upon him not to escape the process of law again.

The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
