Petitioner, who has already been declared proclaimed offender vide order dated 18.05.2017 (Annexure P5), passed by the learned Judicial Magistrate Ist Class, Malerkotla, has moved the present petition under Section 482 Cr.P.C. for quashing thereof. Petitioner was involved in a case under Section 13A/3/67 of the Punjab Gambling Act, 1978 and Section 420 IPC and FIR No. 02 was registered on 16.01.2015. Earlier, petitioner had been appearing before the learned trial Court and charge was framed against him and thereafter, he failed to put in appearance. Learned counsel for the petitioner contended that petitioner could not appear before the learned trial Court for some valid reason. However, all these pleas can be taken by moving an appropriate application before the Court concerned which had declared the petitioner as proclaimed offender on 18.05.2018 and this Court expects that the Court concerned shall DEEPAK KUMAR BHARDWAJ 2018.11.28 15:33 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-50523 of 2018 take into consideration all these facts. However, no case is made out for quashing of the impugned order dated18.05.2017 (Annexure P5) and hence, present petition stands dismissed.
