(ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of certiorari to set aside the appointment letter dated 19.04.2021 (Annexure P-5) vide which respondent No.3, who is lower in merit has been appointed as Ombudsman for District Hisar, ousting the petitioner without any valid reason, despite being higher in merit. 2.

Learned counsel for the petitioner submits that qua his aforesaid grievance, petitioner submitted a representation followed by reminder but to no avail. Thereafter, he caused issuance of a legal notice dated 14.07.2021 (Annexure P-7), the same has also not been adverted by the respondents. Hence, the instant petition. 3.

Learned State counsel, on advance service, joins proceedings and accepts notice on behalf of the respondent-State of Haryana and states that competent authority shall take appropriate decision on the pending legal notice dated 14.07.2021 (Annexure P-7).

At this stage, learned counsel for the petitioner also submits that let a final decision is taken, either way, by the competent authority on the pending legal notice dated 14.07.2021 (Annexure P-7), giving reasons thereof.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per legal notice dated 14.07.2021 (Annexure P7) and also by keeping in view the contentions raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of two months from today.

Disposed of accordingly.
