**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks bail pending trial in FIR No. 25 dated 12.2.2015 under Sections 420/465/467/468/471/120-B/511 IPC registered at Police Station Civil Lines, District Bathinda. Notice of motion.

On the asking of Court, Mr. K.D.Sachdeva, Additional A.G. Punjab, accepts notice.

Learned counsel for the petitioner places reliance on order dated 12.3.2015 passed in CRM-M-6924 of 2015 (Bhola Singh and another Vs. State of Punjab), to contend, inter alia, that real culprits have been granted anticipatory bail by this Court. He further submits that the petitioner was, in fact, a victim and not an accused. He also submits that father of the petitioner moved an application dated 19.2.2015 (Annexure P-2), before the Senior Superintendent of Police, Bathinda, for getting conducted a fair and impartial investigation. CRM-M-9471 of 2015 On the other hand, learned counsel for the State, on instructions from SI Jarnail Singh, Police Station Civil Lines, Bathinda, submits that only an attempt was made to commit an offence under Section 420 IPC. He further submits that although neither any bank account was opened, nor the amount in question was withdrawn, but the petitioner tried to commit the offence. He prays for dismissal of the petition.

Having heard the learned counsel for the parties and after careful perusal of the record of the case, this Court is of the considered opinion that petitioner deserves the concession of bail pending trial. It is so said, because neither the petitioner is beneficiary nor he withdrew any amount.

In view of the above, present petition is allowed. Petitioner is directed to be released on bail pending trial on his furnishing adequate bail bonds/surety bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Bathinda.

Disposed of, accordingly.
