Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the interest @ 12% on the delayed payment of Gratuity and leave encashment as the same was wrongly withheld due to the disciplinary proceedings commenced illegally after the retirement of the petitioner which were later withdrawn by the respondents and the delay having been caused due to the actions/inactions on behalf of the respondents. 2.
Learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 14.03.2026 (Annexure P-9) of the MOHD YAKUB 2026.04.22 16:00 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh.
CWP-11976-2026 petitioner is decided by respondent No.3 by passing a speaking order in a time bound manner.

Mr. Himmat Singh, Advocate has put in appearance on behalf of respondent No.3 and file Memo of Appearance, which is taken on record. The Registry is directed to tag the same at appropriate place. 4.
Learned State counsel, appearing on advance notice, as well as learned counsel for respondent No.3 submits that they have no objection, in case a direction is issued to the respondent No.3 for timebound consideration and decision of the legal notice dated 14.03.2026 (Annexure P-9) of the petitioner by passing a speaking order. 5.
Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent No.3 is directed to consider the legal notice dated 14.03.2026 (Annexure P-9) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.3.
