Prayer in the present petition is for grant of two weeks interim bail to the petitioner in a case FIR No.294 dated 24.11.2020 registered under Sections 21(c), 25 of NDPS Act, 1985 at Police Station Tarn Taran to enable him to attend the last rights/Bhog ceremony of his grandmother, which is scheduled to be performed on 11.6.2022. Learned counsel for the petitioner inter alia contends that the petitioner was arrested for keeping in his conscious possession 265 grams of heroine falling in commercial category. The regular bail preferred by the petitioner was declined by the learned Special Court, Tarn Taran vide order dated 17.8.2021. Thereafter, he filed CRM-M-36411-2021 before this Court and the same was dismissed as withdrawn on 5.4.2022. Now the petitioner has prayed for interim bail for attending Bhog ceremony of his grandmother. Learned counsel for the petitioner has submitted that the Panchayat has no objection for his attending the Bhog ceremony. He submits that in view of the aforesaid circumstances, the petitioner be granted interim bail.

CRM-M-26266-2022 -2There is nothing on record showing that other family members of the petitioner are not available for performing the ceremony as asserted. Keeping in view the facts and circumstances of the present case and the seriousness of the offence committed by the petitioner, this Court finds no substance in the contentions raised and the same are hereby declined.
