(ORAL) The present petition filed under Section 438 CR.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.67 dated 29.08.2019, under Sections 341, 323, 355, 506, 148 and 149 IPC (offence under Section 295 IPC added lateron), registered at Police Station, City Ahmedgarh, District Sangrur.
Issue notice of motion.
Mr.Hittan Nehra, Addl.A.G., Punjab, accepts notice on behalf of the State.
Heard.
The similarly situated co-accused have since been granted anticipatory bail vide orders dated 18.11.2019 passed in CRM-M-412302019 and 19.08.2020 passed in CRM-M-23380-2020. CRM-M-24160-2020 -2direction to the petitioner to join the investigation and on his doing so, he be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C.
In case, the petitioner do not join the investigation or do not cooperate in the investigation, the respondent/State shall be at liberty to file an application for cancellation of their anticipatory bail. August 25, 2020 ( NIRMALJIT KAUR ) meenuss JUDGE 1.
