Challenge in the present writ petition is to the order dated 28.07.2009 (Annexure P-4) passed by respondent No.1 whereby on an application filed by respondent Nos.2 to 13, the water- channel was changed. 6.

Today, learned counsel appearing on behalf of respondent Nos.2 to 13 states that he would have no objection if the order dated 28.07.2009 (Annexure P-4) is quashed and liberty is granted to respondent Nos.2 to 13 to approach the Authorities of the Canal Department in accordance with law. 7.

In view of the statement made by learned counsel for respondent Nos.2 to 13, the present petition is allowed. The impugned order dated 28.07.2009 (Annexure P-4) is set aside. Needless to say that respondent Nos.2 to 13 would always be at liberty to avail their remedies as available in law. Pending applications, if any, also stand disposed off.
