Present petition has been filed, under Section 483(3) BNSS, 2023 (Section 439(2) Cr.P.C.) for cancellation of anticipatory bail granted to the Accused/Respondent No.2 on his 3rd anticipatory bail application by learned Addl. Sessions Judge, SAS Nagar, vide order dated 06.05.2025 (Annexure P-3), wherein order dated 29.04.2025 (Annexure P-4) was made absolute, in case, FIR No. 138 dated 15.12.2024 u/s 125, 115(2), 316(2), 3(5) of BNS (Section 238 BNS added later on) (corresponding to Sections 337, 323, 406, 34 and 201 IPC) & Section 25 of Arms Act, 1959, (Sections 27, 54, 59 of Arms Act, 1959, added later on), registered at Police Station I.T. City, SAS Nagar. 2.

This Court finds that the jurisdiction under Section 483(3) of BNSS, 2023, is not to be exercised as that of an Appellate Court over the LAVISHA 2026.04.23 18:20 I attest to the accuracy and integrity of this document PHHC, Chandigarh
