The instant petition has been filed on behalf of the complainant seeking setting aside of order dated 16.7.2021 (Annexure P-4) passed by JMIC, Moga vide which one of the accused i.e. respondent No.2-Kartar Kaur was permitted to go abroad upto 21.8.2021.

Respondent No.2/accused/applicant-Kartar Kaur, however, approached this Court by way of filing CRM-M-29349 of 2021, wherein a prayer was made for modification of order dated 16.7.2021 passed by JMIC, Moga, so as to extend the period of visit.

The aforesaid petition was accepted by this Court vide order 27.7.2021 and while extending the period of stay upto 31.10.2021, directed that the said PANKAJ KAKKAR 2021.07.29 20:23 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-29583-2021 (O&M) applicant/Kartar Kaur instead of depositing an amount of `8 lakhs, shall deposit an FDR for an amount of `12 lakhs, which she would not be able to encash except with the permission of the Court. The Trial Court was also directed to issue necessary directions to the bank concerned. 4.
Faced with the aforestated position, learned counsel for the petitioner submits that in view of the aforestated position wherein the matter has already been dealt with by this Court, she may be permitted to withdraw the instant petition.

In view of the aforesaid submission, the instant petition is hereby dismissed as withdrawn.
