Mr. Gaurav Bansal, AAG, Haryana *** Petitioner Santosh Kumar Gupta and respondent no. 2 Abhishek Setia are present along with their counsel.
Learned counsel for the petitioner states that the matter has been compromised between the parties, inasmuch as a sum of Rs.26 lacs has been deposited by the petitioner by way of RTGS in the account of the complainant, whereas regarding remaining amount, 15 post dated cheques have been issued. This fact is admitted by complainant Abhishek Setia. Learned State counsel on instructions from ASI Rajpal submits that petitioner has since joined the investigation and his custodial interrogation is not required.
Under such circumstances, the interim bail granted to the petitioner on 22.12.2017 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C.
The petition stands allowed accordingly.
