The present writ petition has been filed under Article 226 of the Constitution of India with a prayer for issuance of an appropriate writ or order in the nature of certiorari for setting aside the action of respondents in treating respondent No.5 as eligible for promotion to the post of Leading Fireman prior to 19.09.2018 by wrongly counting the service rendered by him as Fireman in Nagar Council, Kotakpura prior to his transfer on own request to Nagar Nigam/Municipal Council, Moga. Further praying for issuance of a writ in the nature of mandamus directing the respondents to decide and dispose of the representation dated 08.12.2025 (including legal notice dated 15.07.2023) (Annexure P-10) by passing a reasoned and
speaking order after affording an opportunity of hearing to all affected parties.

Learned counsel for the petitioner has limited his prayer to the extent that the present petition be treated as a comprehensive representation and the same be decided in a time bound manner by passing a speaking order after affording an opportunity of being heard. 3.
On advance notice, Mr. Vikas Sonak, learned Assistant Advocate General and Mr. D.K. Singal, Advocate appeared on behalf of respondents No.1 to 3 and respondent No.4 respectively and filed memo of appearance on behalf of respondent No.4 and they accept notice on their behalf. Registry is directed to place the memo of appearance at an appropriate place. They submit that the claim of the petitioner would be considered by passing a speaking order in accordance with law by respondent(s)/competent authority.

Therefore, in view of the submission made by learned counsel for the petitioner, the present writ petition is disposed of and the respondent No.3/competent authority is directed to treat the present writ petition as representation and consider the claim of the petitioner and pass a speaking order, after affording her an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. 5.
Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by the respondents.

Pending miscellaneous application(s), if any, be also disposed of accordingly.
