(Oral) Prayer in the present petition is for setting aside the impugned order dated 18.12.2015 (Annexure P/3) passed by the learned Judicial Magistrate First Class, Panipat and order dated 09.09.2017 (Annexure P/7) passed by the learned Sessions Judge, Panipat vide which the maintenance to respondent No.1 was enhanced from Rs.20,000/- to Rs.25,000/- per month without any justified reason and without considering the fact that the petitioner is unemployed because of the arbitrary and illegal harassment on behalf of respondent No.2-wife, in the application under Section 125 CrPC (Annexure P/1) filed by the respondents.
Learned counsel appearing for the respondents, who is appearing on behalf of the petitioners in the connected case (i.e. CRM-M-49140-2017), submits that the present matter has been rendered infructuous as the old disputes stand settled between the parties and now, the parties have been granted divorce by a mutual consent vide decree dated 21.09.2023 passed by the learned Family Court, Panipat.

CRM-M-49714-2017 [2] Accordingly, in view of the statement of learned counsel appearing for the respondents, who is appearing on behalf of the petitioners in the connected case (i.e. CRM-M-49140-2017), the present petition is disposed of as having been rendered infructuous. However, in case anything survives, liberty is granted to the petitioner to revive the same, within a period of three months from today, if so advised.
