Learned counsel for the petitioners states that as per order dated 06.07.2020, the application of the petitioner was dismissed under Order 9 Rule 13 CPC by respondent No. 3. The petitioner has now preferred an appeal against order dated 06.07.2020 along with stay application and the stay application was dismissed vide order dated 20.07.2020 (P-8). Learned counsel for the petitioners submits that the appeal is now listed for hearing on 10.10.2020.

In view of the above factual position, this petition is being disposed of by giving direction to respondent No. 2 to pass speaking order on the appeal filed by the petitioner, which is listed for hearing on 10.10.2020 expeditiously, preferably within a period of two months from the date of receipt of certified copy of this order.
