(ORAL) Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.147 dated 25.04.2017, registered under Sections 406, 420, 467, 468, 471 and 120-B IPC, at Police Station Kundli, District Sonipat. It is contended by learned counsel for the petitioner that the petitioner is in custody since 22.08.2017 and the report under Section 173 Cr.P.C. has already been submitted before the trial Court and the charges have been framed on 01.12.2017. Further submitted that till date none of the prosecution witness has deposed against the petitioner before the learned trial Court that he was a beneficiary in this case. CRM-M-49831-2017 -2On the other hand, the present bail application has been opposed by learned State counsel.

Keeping in view the fact that the petitioner is not a beneficiary in the present case and the final conclusion of trial is to take a long time and thus, it would be just and appropriate if the concession of bail is granted to the petitioner. Moreover, the petitioner is in custody since 22.08.2017 and no useful purpose would be served by keeping him behind the bars. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
