**** JAGMOHAN BANSAL , J. (Oral) On 16.05.2018, the following order was passed : "Heard.

Learned counsel for the petitioners herein contends that the petitioners herein are ready to settle the dispute amicably with the complainant and have been declared as proclaimed persons by an order dated 03.12.2015. It is contended that none of the petitioners were in India on that date and in fact, had left for Italy on 18.08.2012 much prior in time to the registration of the FIR. It is submitted that there is non-compliance of the provisions of Section 82 Cr.P.C. It is also contended that they are ready to join the proceedings and prayed for stay of arrest at the Airport to enable them to approach the trial court.

In the meantime, arrest of the petitioners is stayed with the directions to join the proceedings before the trial court on or before 15.07.2018 and on their doing so, they are directed to be released on interim bail by the trial court to its satisfaction. It is made clear that in case, the petitioners fail to join the proceedings before the trial court on or before 15.07.2018, any protection granted to the petitioners herein shall stand automatically vacated."

Learned State counsel and counsel for the complainant would submit that petitioner in compliance of order dated 16.05.2018 of this Court has not surrendered, thus, the present petition needs to be dismissed. The petitioner has not complied with order dated 16.05.2018 and there is no application on behalf of the petitioner seeking extension of time granted by this Court. It appears that the petitioner has lost his interest to pursue the matter.

Dismissed.
