The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 15.12.2008 (Annexure P-2) whereby he was ordered to compulsorily retire as per Rule 9.18(2) of Punjab Police Rules, 1934 as applicable to State of Haryana.

The impugned order was passed on 15.12.2008. The notice was issued, however, there was no stay in favour of the petitioner, thus, impugned order was implemented and petitioner was made to retire on attaining age of 55 years.

The petitioner was made to retire on attaining the age of 55 years and his service was pensionable, thus, he must have received DEEPAK BISSYAN 2025.08.22 10:33 I attest to the accuracy and integrity of this document

CWP-21508-2008 (O&M) -2pension which is 50% of last drawn salary. He had not worked during said period. Thus, at this stage, this Court does not find it appropriate to set aside orders whereby petitioner was made to retire. 4.

Dismissed.
