**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. This is a petition under Section 482 Cr.P.C. for issuance of a direction to the official respondents for conducting proper investigation in case FIR No. 118 dated 8.6.2020 (Annexure P-6) and to take action against respondent No. 4 for destroying the crops of the petitioner and misusing the police protection granted to him.

Learned counsel for the petitioner submits that respondent No. 4 is an ex-serviceman and an Advocate. He further submits that there was a compromise between the family but respondent No. 4 has backed out from the said compromise. Learned counsel also submits that the petitioner has also filed a suit for permanent injunction in which status quo was granted on 25.6.2020 in the presence of both the parties. He further submits that the proceedings under Section 182 Cr.P.C. have also been initiated against respondent No. 4.

CRM-M No. 24934 of 2020 -2AAG, Haryana, accepts notice on behalf of the State. Without going into the merits of the present case, the present petition is disposed of with liberty to the petitioner to approach the Magistrate concerned with all the pleas, as have been raised in the present petition, if so advised, in terms of the judgment of the Hon'ble Supreme Court in Vinubhai Haribhai Malaviya and Ors. Vs. The State of Gujarat and Anr., 2019 AIR (SC) 5233. On his doing so, the Magistrate concerned would take the cognizance of the application and decide the same, preferably within two months.
