This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 164 dated 01.12.2014 under Sections 15/61/85 of the NDPS Act at Police Station Amargarh, District Sangrur. Learned counsel for the petitioner submits that petitioner was not caught on the spot. He has been falsely implicated in the case. Thus, he deserves the concession of anticipatory bail.

Plea has been vehemently opposed by learned State counsel. According to him, in the instant case huge recovery of 171⁄2 Qtls. of poppy husk was effected. Petitioner and other accused are supplier of poppy husk. Custodial interrogation of the petitioner is required for recovering Innova Car and six more bags of poppy husk.

I have heard learned counsel for the parties. According to allegations, an Innova car was used to AJAY KUMAR 2015.04.13 13:44 I attest to the accuracy and authenticity of this document

CRM-M 9721 of 2015 bring poppy husk from Rajasthan. On the fateful day, same was unloaded in the cremation ground of village Manvi Bulapur. According to information received by the police, poppy husk was in possession of the accused including the petitioner. Name of the petitioner figured in the FIR itself.

Under the circumstances, I do not find any merit in the plea that petitioner has been falsely implicated. Investigation has to be taken to its logical end. There is, thus, no merit in the petition. Dismissed.
