The prayer made in the present petition is for directing the respondent No.1 to decide the representation dated 26.09.2023, Annexure P-4 and further directing the respondent No.2 to decide the representation dated 05.02.2024, Annexure P-5, wherein request was made to them to release the retiral benefits of the petitioner.

Learned counsel would submit that the petitioner had retired as Emergency Medical Officer on 28.02.2023 on attaining the age of superannuation. However, his retiral benefits have not been released, despite the fact that there is no departmental enquiry pending against him. In this regard, representations dated 26.09.2023, Annexure P-4 and 05.02.2024, Annexure P-5, have been submitted, which have yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner, in case, a direction is given to respondent Nos.1 and 2 to decide the same in a time bound manner by granting him an opportunity of hearing.

At the asking of the Court, Mr. Nitin Kaushal, Advocate accepts notice on behalf of the respondents-University and has no objection to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent Nos.1 and 2 to decide the representations dated 26.09.2023, Annexure P-4 and 05.02.2024, Annexure P-5, within a period of three months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
