***** Rajan Gupta, J. (Oral) This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No.158 dated 16.10.2016 under Sections 377, 506 IPC at Police Station City Samana, District Patiala.

Learned counsel for the petitioner contends that the petitioner is in custody since 20.10.2016. Case is triable by Magistrate and no useful purpose would be served by detaining him in any manner. Learned State counsel has opposed the prayer for bail on the ground that offence is serious in nature.

Heard.

In view of the above, this court does not intend to express any opinion on the merits of the case. However, keeping in view the fact that the case is triable by Magistrate, period of incarceration and the fact that trial is not likely to conclude at an early date, I deem it appropriate to grant regular bail to the petitioner.
