RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Parnam Singh alias Pani in a case arising from FIR No.140 dated 03.09.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Sultanwind, District Police Commissionerate, Amritsar. According to the prosecution, on 03.09.2018 910 intoxicant tablets were found in conscious possession of the petitioner without any permit or licence.
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 03.09.2018.
In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing RAVINDER SINGH 2018.11.27 15:38 I attest to the accuracy and authenticity of this document personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of
-2CRM-M-50825 of 2018 Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
