RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner-Gurjeet @ Gurjit Singh, in a case arising out of FIR No.80 dated 19.07.2018, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Sirhind, District Fatehgarh Sahib. According to the prosecution, 45 injections of Buprenorphine I.P. Leegesic (2 ml each) and 35 bottles of Avil (10 ml each) were recovered from the conscious possession of petitioner and his co-accused without any permit or license.
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. CRM-M-50828-2018 -2merits of the case, the petitioner is granted interim bail subject to furnishing personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
