Jaswant Singh,J.(Oral) Prayer is for grant of anticipatory bail in case FIR No.325 dated 2.5.2014 for offences punishable under Sections 323, 324,506 and 34 IPC (Sections 147,148,149,326 IPC and Section 25 of the Arms Act added during investigation),PS Sohna,Distt.Gurgaon. It was contended that the petitioner was not named in the eye witness account by Shamsher Singh, complainant,however, after a considerable lapse of time on the statement of injured Parmod only to the effect that the petitioner had also inflicted sword blow without specifying any part of the body, the petitioner was nominated as an accused. It was further contended that the petitioner has neither been challaned nor even summoned under Section 319 Cr.PC as the other co-accused have been.

CRM-M 8626/2016 Learned counsel for the complainant acknowledges the fact of compromise between the parties.

Learned State counsel submits that petitioner has joined investigation, however,recovery of weapon of offence i.e. sword is yet to be effected. He,however, in the light of complainant himself acknowledging compromise does not oppose grant of anticipatory bail. In view of the above interim bail granted vide order dated 16.3.2016 is made absolute.

Disposed of.
