NARESH KUMAR SANGHI, J (Oral) This order shall dispose of above captioned three petitions, under Section 438, Cr.P.C., filed by Surinder Singh son of Kabul Singh, Kuldeep Kaur wife of Surinder Singh, and Ramandeep Kaur daughter of Surinder Singh, respectively, all residents of Railway Road Nangal, Tehsil Nangal, District Ropar, for grant of anticipatory bail, who have been booked for having committed the offences punishable under Sections 307, 406 and 498-A, IPC, in a case arising out of FIR No. 4, dated 11.1.2014, registered at Police Station, Singh Bhagwantpur, District Rupnagar.
Learned counsel for the petitioner(s) submits that during pendency of the FIR and the present petitions, better sense has prevailed and both the private factions have resolved the matrimonial dispute and effected a compromise. They have decided that the informant/complainant, Inderjit Kaur (wife) would join the company of her husband, Vimal Singh, who is presently residing in Australia. He further submits that all the relevant documents for getting a Visa, in addition to the cash amount of `1,00,000/- (Rupees one lac only), has been provided
to the informant, Inderjit Kaur. The remaining documents, if any, required by Inderjit Kaur, shall be provided to her within fifteen days of passing of this order.
Learned counsel for the State on instructions from ASI Narender Singh of Police Station, Singh Bhagwantpur, District Rupnagar, submits that the petitioners have not joined the investigation, but in view of the fact that the present criminal litigation has arisen out of a matrimonial dispute and the same has been resolved, therefore, he would not oppose the grant of anticipatory bail to the petitioners. He further submits that while making the interim-directions absolute, the petitioners be directed to join the investigation as and when required to do so by the investigating agency.
Learned counsel for the informant, Inderjit Kaur, submits that the compromise has been effected, but certain documents have not been provided to her (Inderjit Kaur) so that she may get the Visa. He further submits that in case the required documents are provided to her within fifteen days of passing of this order, then she (Inderjit Kaur) has no objection in grant of anticipatory bail to all the three petitioners.
After hearing learned counsel for the parties and going through the material available on record, all the three petitions, captioned above, are allowed. The interim directions dated 21.3.2014 (in CRM-M-9862-2014), 2.4.2014 (in CRM-M11416-2014) and 24.4.2014 (in CRM-M-13460-2014) are made absolute.
The petitioners, namely, Surinder Singh son of Kabul Singh, Kuldeep Kaur wife of Surinder Singh, and Ramandeep Kaur daughter of Surinder Singh, shall join the investigation as and when required to do so by the investigating agency. They shall also abide by all the conditions laid down in Section 438(2) Cr.P.C.
In case the petitioners do not provide the required documents to the informant, Inderjit Kaur, for arranging her Visa to go to Australia, the informant/complainant side would be at liberty to move an application for withdrawal of the concession being granted to the petitioners.
