Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the action of the respondents vide which the benefit of Assured Career Progression (ACP) Scheme dated 03.11.2006 (Annexure P-2), has been withhold. Further a writ of mandamus has been sought for directing the respondents to revise the pay and pension of the petitioner after releasing the benefit of ACP increments in terms of the Instructions dated 03.11.2006 (Annexure P2), to the petitioner along with all consequential benefits with interest @ 18% per annum.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 22.12.2023 (Annexure P-6). Mr. Rakesh Roy, Advocate, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1, to decide legal notice dated 22.12.2023 (Annexure P-6), expeditiously submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
