Learned State counsel at the outset, on instructions from Ms. Charu Chitra, ETO, submits that registration certificate of the petitioner stands cancelled w.e.f. 31.03.2003. The petitioner is no more in business. Adjudication of instant petition would be mere an academic exercise. The authorities are unable to collect record and proceed against the petitioner. 2.

Learned Senior Counsel for the petitioner expressed his inability to controvert aforesaid fact and submitted that he has no contact with his client. As per record, tax stands paid. The petitioner may be granted liberty to move an appropriate application, if at any stage, respondent starts recovery proceedings against it.

In the wake of statement of both sides, the petition stands disposed of with aforesaid liberty.
