The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent No. 2 to re-issue them passport.

The petitioners were issued passport on 01.11.2012 which expired on 31.10.2022. The petitioners applied for re-issuance of passport. An FIR No. 37 dated 22.04.2016, under Sections 406 and 498-A of IPC came to be registered against the petitioners at Police Station, Nurpurbedi, District Rupnagar. The petitioners preferred CRM-M-13648 of 2017 before this Court seeking setting aside of aforesaid FIR. This Court has stayed proceedings pending before trial court.

Learned counsel for the petitioners submits that case of the petitioners is squarely covered by judgment of this Court in Mohan Lal @ PARAMJIT KAUR SAINI 2023.12.06 16:16 I attest to the accuracy and authenticity of this order/judgment
CWP No.10988 of 2023 -2 2023:PHHC:155560 Mohna vs. Union of India and others 2023 SCC Online P&H 1391 as well as instructions dated 14.03.2023 issued by Central Government. 4.
Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioners may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks.

Learned counsel for the petitioners agrees to the aforesaid arrangement.

In the wake of statements of both sides, that petition stands disposed of with a direction to petitioners to appear before passport authority on 15.12.2023 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks from 15.12.2023.
