RAMENDRA JAIN, J. (ORAL) Despite the case having been called twice, none has put in appearance on behalf of the petitioner.
Learned State counsel submits that the instant petition has rendered infructuous, in view of the fact that after filing of this petition, Special Investigation Team, was constituted, who found the petitioner guilty for keeping in conscious possession of 188 grams of intoxicant powder containing salt Alprazolam. Final report under Section 173(2) Cr.P.C. has been filed and charge under Section 22 of the NDPS Act, has also been framed against the petitioner.
In view of the above, the instant petition is dismissed on following two counts:- (i) as having rendered infructuous; and (ii) for want of prosecution as well.
