The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case bearing Crime No.3 dated 21.01.2018 registered for the offences under Sections 8, 18 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act') at Police Station NCB, Chandigarh for a period of two months in pending trial to the petitioner on medical ground. Notice of motion to Advocate General, Punjab. Mr. D.D. Sharma, learned Advocate has put in appearance on behalf of respondent-NCB, Chandigarh and contested this petition. I have heard learned counsel for the petitioner and learned Advocate for respondent-NCB and have gone through the record. From the record, I find that in the present case, the wife of the HARPAL SINGH PARMAR 2018.12.11 14:12 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-50902 of 2018 [2] petitioner delivered a child on 8.8.2018, but the child died on the next day. The petitioner has requested for interim bail for two months on the ground that he has to look after his wife. The child was born on 8.8.2018 and more than four months have already passed. No document has been placed on record by the petitioner to show that there is any serious medical problem now to the wife of the petitioner or she requires bed rest so she requires the special care of the petitioner.
Keeping in view the above facts and circumstances, I do not find any merit in this petition and the same is dismissed. December 10, 2018.
