(Oral) This is the third petition filed under Section 439 Cr.P.C. for grant of bail to the petitioner, in case FIR No. 331, dated 29.06.2020, registered under Sections 307, 323, 506 of IPC (added later on Section 302 of IPC) (supplementary challan under Section 302 of IPC is yet to be presented before the trial Court), lodged at Police Station Sadar Thanesar, District Kurukshetra. At the outset, learned counsel submits that a false case has been planted upon the petitioner on account of some previous enmity. Hence, he be extended the concession of bail.

However, learned counsel for the petitioner has failed to satisfy this Court qua any substantial change in circumstances, which would warrant entertaining the instant petition. Moreover, the case in hand is based on ocular testimony of the complainant, wherein, a specific role has been attributed to the petitioner of having entered the house of the deceased and thereafter, having inflicted a Fawra blow on his head, as a result of which, the deceased met his end. Not only this, there are also allegations levelled against the petitioner of having JAWALA RAM 2021.08.06 10:18 I attest to the accuracy and integrity of this document

CRM-M-29669-2021 - 2 - attacked the mother of the deceased with a screwdriver on the following day of the occurrence.

After arguing for sometime, when this Court was not inclined to accept the prayer of the petitioner, a prayer was made for withdrawal of the instant petition.

Dismissed as withdrawn.
