Present petition was registered on the basis of a letter addressed by convict - Vijay Singh - to Hon'ble the Chief Justice, wherein it has been stated that despite having spent 11 years in Jail he was not granted parole. 2.
Reply has been filed by the State wherein it has been stated that the convict, namely, Vijay Singh was convicted for commission of offence punishable under Section 302 of the Indian Penal Code, 1860 (for short 'IPC') vide order dated 14.11.2014 in case FIR No.222 dated 31.08.2013 registered under Sections 147, 148, 149, 302, 216 and 34 IPC at Police Station Bhattu Kalan, District Fatehabad and was sentenced to undergo rigorous imprisonment for life. Convict - Vijay Singh - was transferred from Model Jail, Chandigarh to District Prison, Sirsa on 31.10.2019. As per jail record, Vijay Singh applied before the Superintendent of Prison, Model Jail,
CRWP-4197-2025 -2Chandigarh for his temporary release on parole for a period of six weeks for agricultural purpose. The parole case of Vijay Singh was initiated while he was lodged in Model Jail, Chandigarh. On 01.04.2015 Vijay Singh was released on parole for a period of 42 days. The said order was challenged by the complainant by filing CRWP-634-2015. Vide order dated 08.05.2015 the order releasing Vijay Singh was stayed. Subsequently, he was taken into custody on 12.05.2015. It was observed in the order dated 08.05.2015 that the Superintendent of Police, Fatehabad and District Magistrate had not referred to the alleged murder committed by Vijay Singh while he was released on bail in another matter. Thereafter, another application was filed for grant of parole on 08.04.
2016, which was rejected by the Inspector General of Prisons, UT Chandigarh on 04.11.2016. Vijay Singh challenged the said order by filing CRWP-563-2017 titled 'Vijay Singh vs. Govt. of U.T. Chandigarh & Ors' which was dismissed as withdrawn vide order dated 16.05.2017. Thereafter, Vijay Singh filed CRWP-763-2017, which was also dismissed as withdrawn on 13.11.2017. The application filed by Vijay Singh for grant of furlough was also rejected vide order dated 13.04.2020. Yet again another application was submitted on 04.01.2021 for grant of furlough, which was dismissed on 05.05.2021. However, in the meantime, Vijay Singh had filed CRWP-97532021, which was dismissed as withdrawn vide order dated 25.10.2021 with liberty to take remedial steps as order dated 05.05.2021 had not been challenged.
Thereafter, CRWP-10500-2021 was filed challenging order dated 05.05.2021, which was dismissed vide a detailed order on 11.01.2022. The said order was challenged by filing SLP (Criminal) No.5714 of 2022, which was dismissed vide order dated 05.09.2022. Thereafter, various other applications were filed, which were also rejected.

Learned State counsel has pointed out that the letter on the basis of which the present petition was registered suo motto does not mention any such details. The facts narrated above reveal that despite being convicted of an offence under Section 307 IPC, Vijay Singh alongwith his sons butchered the victim/witness in an earlier case i.e. FIR No.74 dated 08.04.2009 during the concession of suspension of sentence.

Keeping in view the facts as narrated above as also the fact that the main appeal being CRA-D-132-DB-2015 itself is listed for hearing, we do not find any ground to entertain the present petition. 5.
