Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 260 dated 19.11.2017, registered under Section(s) 399 & 402 IPC and Sections 25/27/54/59 of the Arms Act, 1959 at Police Station Jandiala, District Amritsar. Petitioner is an accused in case FIR No. 260 dated 19.11.2017 and was admitted to regular bail on 02.01.2018. Thereafter, his bail was cancelled on account of his non-appearance in the learned trial Court and non-bailable warrants arrest were issued against him vide order dated 02.06.2018.

The learned Sessions Judge, Amritsar, while taking a lenient view, granted interim pre-arrest bail to the petitioner on 15.01.2019 and directed him to appear before the learned trial Judge within a period of ten days, but he failed to comply with the said order. Criminal Misc. No. M-23437 of 2019 dismissed by the learned Sessions Judge vide order dated 30.03.2019. As such, no case is made out to grant the concession of pre-arrest bail to the petitioner and present petition stands dismissed. However, in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for granting him regular bail, the learned trial Judge shall decide the same within a period of one week, thereafter.
