CORAM:

HON'BLE MR. JUSTICE R.P. NAGRATH

Present:

Ms. Sushma Chopra, Advocate for the petitioner.

Mr. L.S. Sidhu, Advocate for the respondent.

R.P. Nagrath, J. (Oral) This order will dispose of aforesaid three petitions as the prayer in all these petitions is made under Section 407 read with Section 482 Cr.PC. for transfer of criminal appeals filed by the petitioner against the judgment of conviction and sentence under Section 138 of the Negotiable Instruments Act in the complaints filed by the respondent.

CRM-M-990 of 2015 -2I have heard learned counsel for the parties, perused the paper-book and find that in the facts and circumstances the prayer for transfer is not justified.

In the appeal against conviction the petitioner is being represented by Sh. Inderjit Singh, who is indisputably quite a senior advocate of District Courts Mansa.

Learned counsel for the petitioner, however, urged that there is always an apprehension in the mind of petitioner that justice may not be done to him because he had quite serious dispute with certain advocates of District Mansa and out of those very advocates, the respondent-complainant is being represented. Despite of above circumstance, this Court is quite sanguine that the appeals would be disposed of on its own merits. In fact there is no assertion of the appellate Court having any kind of bias against the petitioner.

With the aforesaid observations, I find no force in the instant petitions and the same are dismissed. May 12, 2015 ( R.P. NAGRATH ) jk JUDGE JITENDER KUMAR 2015.05.14 10:16 I attest to the accuracy and authenticity of this document Chandigarh
