Petitioner has filed this petition under Section 482 Cr.P.C. for quashing of FIR No. 1040 dated 16.12.2013 registered under Sections 323, 406, 498-A & 506 IPC at Police Station Karnal Civil Lines, District Karnal and the subsequent proceedings arising therefrom.
Learned counsel for the petitioner submits that only false allegations have been leveled in the FIR just to implicate the petitioner. Judicial Magistrate Ist Class, Karnal ordered registration of FIR under section 156(3) Cr.P.C. without proper appreciation of facts. Infact court at Karnal had no jurisdiction to entertain application under section 156(3).
I have heard learned counsel for the petitioner. Complaint was lodged by Javir Kaur w/o Parminder Singh stating that marriage between them was solemnized on 24.02.2010. From the wedlock, a son was born on 08.10.2011. However, after some time petitioner starting doubting character of the complainant and began to ill-treat her. CRM-M 9900 of 2015 was pregnant, accused kept on inflicting physical and mental torture.
I am of the considered view that allegations leveled in the FIR can only be gone into by the trial court when evidence is led before it. Plea that FIR could not be registered at Karnal is without any merit. Petitioner has already been granted the concession of pre-arrest bail. However, there is no ground to quash the FIR in inherent jurisdiction of this court. Dismissed.
