Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the impugned inquiry report dated 16.09.2020 (Annexure P-2) and impugned punishment order dated 13.01.2021 (Annexure P-3) and in consequence thereof, any recovery made from the petitioner may be refunded with interest @ 9% per annum. Further prayer has been made to stay the operation of the impugned order dated 13.01.2021 (Annexure P-3) during the pendency of the writ petition. 2.

Learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 19.05.2025 (Annexure P-7) of the petitioner is decided by respondent(s)/competent authority by passing a speaking order in a time bound manner.

Learned counsel for the respondents, appearing on advance notice, submits that he has no objection, in case a direction is issued to the respondent(s)/competent authority for time-bound consideration and decision of the legal notice dated 19.05.2025 (Annexure P-7) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent(s)/competent authority is directed to consider the legal notice dated 19.05.2025 (Annexure P-7) of the petitioner and pass a speaking order in the light of the Instructions dated 19.05.2011 (Annexure P-4) and the judgment rendered by this Court in CWP-26799-2014, titled as Sushil Kumar vs Punjab State Power Corporation Limited and others, decided on 05.10.2018 (Annexure P-5), after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent(s)/competent authority.
