Present petition under Section 482 Cr.P.C. for quashing of order dated 08.03.2019 (Annexure P2), passed in complaint bearing No. 880 dated 25.04.2017 under Section 138 of the Negotiable Instruments Act, 1881 by the learned Judicial Magistrate Ist Class, Rohtak, whereby petitioner was declared proclaimed person.
Learned counsel for the petitioner contended that petitioner has already made part payment, but there is no dispute on the fact that because of his conduct and regular default in appearance, he was declared proclaimed offender.
As such, present petition stands dismissed. However, in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for granting him bail, the same shall be decided by the learned trial Judge within a period of three days, thereafter.
