The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondents to grant compensation for premature withdrawal of fixed deposit without prior permission or intimation. He is further seeking direction to the respondents to decide his legal notice dated 04.02.2026. 2.

The petitioner is holding an NRI account with State Bank of India, Karnal Branch. He deposited a sum of Rs.65,00,000/- on 25.07.2022 in the respondent-bank by way of Fixed Deposit for a period of 1 year. The fixed deposit was renewed by the bank from time to time without obtaining prior approval. He approached the bank seeking overdraft of Rs.35,00,000/- for business purposes. The Bank approved the overdraft against FDR and assured that the remaining amount and interest will be credited to his bank account. The respondent wrongly adjusted the overdraft amount from his FDR. CWP-12154-2026 -215.04.2025 instead of 03.04.2025 and wrongly charged interest of Rs.6,387/-. The respondent-Bank has wrongly withheld interest amounting to Rs.3,45,280/- accrued on the principal amount of Rs.73,29,319/-. He served legal notice dated 04.02.2026 upon the respondent-Bank seeking deposit of the interest as well as documents showing alleged renewal of FDR.

On being confronted with the fact that petitioner has remedy to approach Banking Ombudsman as well as Permanent Lok Adalat, learned counsel for the petitioner expressed his inability to controvert the same and seeks permission to withdraw the petition with liberty to avail alternative remedies as permissible by law.

Dismissed as withdrawn with aforesaid liberty. 5.
