Prayer made in the present petition is for directing the respondents to grant family pension to the petitioner, being widow daughter, in terms of instructions dated 29.10.2021.

Learned counsel refers to a clarification dated 28.02.2023 by the Finance Department, as per which the petitioner is entitled to the same, however, vide communication dated 13.01.2025, Annexure P-15, they are not considering the matter and the same has been sent for clarifiation, which is already as above. In this regard, a representation dated 25.04.2024, Annexure P-13, has been submitted, however, the same has yet not evoked any response. He thus, on instructions prays that a direction may be given to the respondents to decide the same in a time bound manner and copy of the aforesaid clarification has been handed over to learned State counsel, who has no objection to the limited prayer made.

In view of the above and without commenting on the merits of the MOHIT 2025.05.05 18:15 I attest to the accuracy and integrity of this document

CWP-12495-2025 (O&M) -2case, this petition is hereby disposed of with a direction to the respondents to consider and decide the representation dated 25.04.2024 within a period of 3 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to her and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to her interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
