R.P. Nagrath, J. (Oral) Prayer in the instant petition is made under Section 439 Cr.P.C. for grant of regular bail in FIR No. 03 dated 07.01.2015 for offence under Section 21 of the Narcotic Drugs and Psychotropic substances Act, 1985 (NDPS), registered at Police Station Bhogpur, District Jalandhar City. The recovery of 120 gms. of heroin was made from possession of the petitioner which is non-commercial. On 06.08.2015, the information was supplied by learned State counsel about 9 FIRs against the petitioner and those were of the year 2005 or before that. Reference was also made to FIR No. 116 dated 21.05.2014 and FIR No. 61 dated 06.11.2014, which were under the NDPS Act, and learned State counsel was directed to file affidavit with regard to recoveries made from the petitioner in those FIRs.
Learned State counsel has filed affidavit of Sh. Jaspreet Singh Sidhu, Senior Superintendent of Police, Jalandhar (Rural), District Jalandhar and it is submitted that no JITENDER KUMAR 2015.08.21 16:47 I attest to the accuracy and integrity of this document
CRM-M-9931 of 2015 -2recovery was made from the petitioner in those FIRs. It is also submitted that the challan has since been presented. The petitioner is in custody since 07.01.2015 and it will take sometime in conclusion of the trial. In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
