The petitioners are close relatives of Rajive Joshi, who was married to complainant Rimple Joshi. The allegation against the petitioners is that they along with Rajiv Joshi and his mother on 5.10.2011 made an attempt to trespass in the house belonging to complainant Rimple Joshi and tried to take forcible possession by throwing out the girl students, who were tenants. The dispute appears to be a matrimonial dispute between Rimple Joshi and Rajiv Joshi, who jointly owned the property. On the instructions of HC Manjit singh, it has been informed that the petitioners have joined the investigation. It does not appear to be a case of custodial interrogation.

The petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioners will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioners will not commit the similar offence, of which they are accused of, during pendency of the trial. May 18 ,2016 ( M.M.S.BEDI ) TSM JUDGE
