Petitioner is aggrieved by the order dated 21.02.2019 passed by learned Additional District and Sessions Judge, as Principal Judge, (Family Court), Jind, vide which interim maintenance @ Rs.10,000/- per month was allowed to the wife under Section 24 of the Hindu Marriage Act. It is not disputed that the present petitioner is serving under the Central Government in Group 'C' Services. This Court is informed that he is working in Indian Postal Services and his monthly salary is of Rs.46,539/-. It is claimed that deductions to the tune of Rs.24,885/- are being made and he is getting salary of Rs.22,851/-per month only. The salary certificate (Annexure P-7) shows that the major recovery of Rs.13,446/-is towards the recovery of the loan. It is the duty of husband to maintain the wife. Balance has to be struck. The needs of the wife are also to be seen. Considering the present level of the essential commodity nowadays. Rs.10,000/- cannot be called excessive maintenance. Dismissed.
