*** The case has been taken up through Video Conferencing. This petition for regular bail has been filed by petitioner Sanvi @ Malti, aged about 44 years, wife of Vakil Chand, resident of Little Flower School Wali Gali, near Church Ghar, Sri Muktsar Sahib, Tehsil and District Shri Muktsar Sahib, an accused in F.I.R. No. 230 dated 2.7.2020 registered with Police Station City Sri Muktsar Sahib, District Sri Muktsar Sahib for offences under Section 20 of the NDPS Act. Briefly stated the prosecution story is that on 2.7.2020, petitioner Sanvi @ Malti along with her co-accused Ashu were found in possession of 43 Kg. Ganja which amount to commercial quantity. Petitioner had filed a petition for regular bail before the lower Court but was unsuccessful, as such she has approached this Court craving for grant of similar relief, which request is opposed by the State counsel. CRM-M-24539 of 2020 I have heard learned counsel for the petitioner and learned State counsel besides going through the record.

The petition is being vehemently opposed by the State counsel. Section 37 of the NDPS Act, 1985 clearly provides that in case the recovered contraband amounts to commercial quantity the accused shall not be released on bail unless the Court is satisfied that there are reasonable grounds for believing that accused is not guilty of such offence or that he is not likely to commit any offence while on bail. I do not see any reason to record the requisite satisfaction, therefore, the petition is bound to fail and is dismissed accordingly.
