This criminal miscellaneous application has been filed under Section 482 Cr.P.C. for impleading the applicants, namely, Gurdev Singh son of Shiv Singh and Smt. Kulwinder Kaur wife of Gurdev Singh as petitioners No.2 and 3 respectively in the above cited criminal writ petition and further to take on record the averments made in this application as part and parcel of this criminal writ petition.
I have heard learned counsel for the applicants and have gone through the record.
From the record, I find that the complaint sent by Parkash Rani to the Hon'ble Judge, Punjab and Haryana High Court, Chandigarh has been treated as criminal writ petition. In the complaint, Parkash Rani alleged that HARPAL SINGH PARMAR 2015.08.14 16:34 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.W-209 of 2015 in Cr.W.P. No.356 of 2015 [2] accused persons, namely, Fauja Singh and Joginder Singh got picked-up her husband, namely, Gurdev Singh through Police in illegal manner on 27.2.2015. Notice of the complaint was taken on the judicial side and notice was issued to the State of Punjab.
The present applicants, who are another Gurdev Singh and Smt. Kulwinder Kaur filed the application for impleading them in this criminal writ petition.
From the record, I find that as per the allegations of these applicants they have been picked-up by the Police on 5.3.2015 and their arrest was shown on 8.3.2015. The cause of action regarding these persons is totally different and not connected with the matter already pending before this Court.
Therefore, I do not find any merit in this application to implead them as party in the present criminal writ petition. However, they are at liberty to avail their independent remedy.
Consequently, this criminal miscellaneous application for impleading Gurdev Singh and Kulwinder Kaur as party is dismissed. August 12, 2015.
